Introduction
Welcome to Gradely. These Terms of Service ("Terms"), together with our Privacy Policy, govern your access to and use of the Gradely website, services, and applications (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Eligibility and Age Restriction
You must be at least 16 years old to create an account and use our Services. If you are under the age of 18 (a "Minor"), you represent that you have obtained the consent of your parent or legal guardian to use the Services. Your parent or legal guardian must review and agree to these Terms on your behalf. We reserve the right to terminate any account if we believe it has been created by a user under 16 or a Minor without proper consent.

Gradely provides pricing data, "value increase" metrics, and market trends as estimates based on first-party sources and third-party sources. These are not official prices or guarantees of value. Actual prices and market conditions may vary. We are not responsible for any financial losses or gains resulting from using our pricing data or recommendations.
- Affiliate DisclosureGradely participates in affiliate marketing programs. If you click on a "Buy" link or price data and make a purchase on a third-party website (such as eBay), we may earn a small commission at no extra cost to you.
- Third-Party TransactionsWe do not sell cards directly. Any purchase made through an affiliate link is a contract between you and the third-party merchant. Gradely is not responsible for the quality, shipping, or fulfillment of these products. Minors must have parental permission before making any financial transactions.
- Not Financial AdviceGradely is not a financial advisor. Trading cards are volatile assets. Any decision to buy, sell, or trade cards based on our data is done at your own sole risk.

The Service, including its design, features, logos, and content created by us, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without our express written permission, including:

- Modifying or otherwise making any derivative uses of the Service or any portion thereof;
- Using any data mining, robots, or similar data gathering or extraction methods;
- Downloading (other than page caching) of any portion of the Service or any information contained therein;
- Reverse engineering or accessing the Service in order to build a competitive product or service;
- Or using the Service other than for its intended purposes. If you breach these Terms, we may immediately terminate your use of the Service.

Gradely is an independent platform and is not affiliated with, endorsed, or sponsored by the publishers listed below. Card images, names, and text are trademarks and copyrights of their respective owners. Our use of these assets is intended for informational, analytical, and review purposes under Australian "Fair Dealing" principles and relevant Fan Content policies:

Limitation of Liability
Nothing in these terms excludes, restricts, or modifies any guarantee or remedy available to you under the Competition and Consumer Act 2010 (Cth).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Gradely provides the Service “as is” and is not liable for any indirect, incidental, or consequential damages, including but not limited to financial losses, loss of data, or errors in card valuations, even if we have been advised of the possibility of such damages.
Account Suspension and Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, upload prohibited content, or harm the platform. You may contact us to delete your account at any time via Gradely Support.
Changes to These Terms
We may update these Terms from time to time. When we make significant changes, we will notify you by email or by posting a notice on our website. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. You and Gradely submit to the non-exclusive jurisdiction of the courts of NSW, Australia for the resolution of any disputes arising from these Terms or your use of our Services.
